DOLE to employers: Observe proper pay rules on January 1


The labor department reminded employers to observe proper payment of wages for workers and employees who report for work on New Year’s Day, January 1, which is a regular holiday.

 

Pursuant to Proclamation No. 555 issued by President Rodrigo Roa Duterte on August 15, 2018, Labor Secretary Silvestre Bello III released Labor Advisory No. 21, prescribing the pay rules for the said holiday.

Employers are bound by the following computation of wages:

If the employee did not work, he or she shall be paid 100 percent of his or her salary for that day ([Basic wage + COLA] x 100 percent); however, if the employee worked on the said holiday, he or she shall be paid 200 percent of his or her wage for that day for the first eight hours ([Basic wage + COLA] x 200 percent).

In addition, if the employee worked in excess of 8 hours (overtime work), he or she shall be paid an additional 30 percent of his or her hourly rate on said day (hourly rate of the basic wage x 200 percent x 130 percent x number of hours worked).

If the employee worked during a regular holiday that also falls on his or her rest day, he or she shall be paid an additional 30 percent of his or her basic wage of 200 percent [(Basic wage + COLA) x 200 percent] + [30 percent (Basic wage x 200 percent)].

Furthermore, if the employee worked in excess of 8 hours (overtime work) during a regular holiday that also falls on his or her rest day, he or she shall be paid an additional 30 percent of his or her hourly rate on said day (hourly rate of the basic wage x 200 percent x 130 percent x 130 percent x number of hours worked).

DOLE sa mga employer: Sundin ang tamang pasahod sa Enero 1

 

Pinaalalahanan ng labor department ang mga employer na sundin ang tamang pagbabayad ng sahod sa mga manggagawa at empleyado na nagtrabaho ng Bagong Taon, Enero 1, na isang regular holiday. 

 

Alinsunod sa Proclamation No. 555 na inilathala ni Presidente Rodrigo Roa Duterte noong Agosto 15, 2018, inilabas ni Labor Secretary Silvestre Bello III ang Labor Advisory No. 21, na nagtatakda ng patakaran sa tamang sahod sa nasabing araw. 

 

Dapat sundin ng mga employer ang mga sumusunod na patakaran sa pagbibigay ng sahod:

 

Kung ang empleyado ay hindi nagtrabaho, tatanggap siya ng 100 porsiyento ng kanyang suweldo para sa nasabing araw ([Basic wage + COLA] x 100 percent); gayunpaman, kung nagtrabaho ang empleyado sa nasabing araw, babayaran siya ng 200 porsiyento ng kanyang suweldo para sa araw na iyon para sa unang walong oras ([Basic wage + COLA] x 200 percent). 

 

Dagdag pa rito, kung nagtrabaho ang empleyado ng mahigit sa walong oras (overtime work), babayaran siya ng karagdagang 30 porsiyento ng kanyang orasang kita para sa nasabing araw (hourly rate of the basic wage x 200 percent x 130 percent x number of hours worked). 

 

Kung ang empleyado ay nagtrabaho ng regular holiday at ito rin ang araw ng kanyang pahinga, babayaran siya ng karagdagang 30 porsiyento ng kanyang arawang sahod na 200 porsiyento [(Basic wage + COLA) x 200 percent] + [30 percent (Basic wage x 200 percent)].

 

Dagdag pa rito, kung ang empleyado ay nagtrabaho ng higit sa walong oras (overtime work) sa nasabing regular holiday at ito rin ang araw ng kanyang pahinga, babayaran siya ng karagdagang 30 porsiyento ng kanyang orasang kita sa nasabing araw (hourly rate of the basic wage x 200 percent x 130 percent x 130 percent x number of hours worked).
