DOLE backs security of tenure bill


The Department of Labor and Employment (DOLE) has thrown its full support to the Senate in the final push for the passage of the Security of Tenure Bill.

Labor Assistant Secretary Joji Aragon said her team was instructed by Secretary Silvestre Bello III to provide all the necessary technical assistance to the senators as the Senate hammers out its version of the job security measure.

 

Senator Joel Villanueva, labor committee chairman, sponsored Senate Bill No. 1826 or the “Act strengthening the workers right to security of tenure” now subject to plenary interpellation.

 

“Upon orders and guidance from Secretary Bello, we are providing assistance to the lawmakers and to Senator Villanueva who sponsored for the passage of the measure. We look forward to its immediate advancement to the bicameral committee,” Aragon said.

Last September 21, President Duterte certified the SOT bill as urgent and requested for its immediate enactment to eliminate illegal forms of labor contractualization in the country.

The proposed law will amend the Labor Code on the prohibition of labor-only contracting and other provisions that allow contracting arrangements. The amendment will also clearly define the nature of the work and activities that may be contracted out.

DOLE has been steadfast in its position that should the duties and responsibilities of a worker be directly related to the main business of the company, such as salesladies working in malls, they shall be considered as regular employees of the principal/ employer.


Under the proposed law, a transition support program for job contracting is provided with a three-month financial support for employees in between job periods and conditioned on undergoing skills training or upgrading under TESDA and accredited training institutions during the period of unemployment.

The Senate is expected to resume deliberations on the bill this week.

Security of tenure bill, suportado ng DOLE

 

Nagpahayag ng buong suporta ang Department of Labor and Employment (DOLE) sa Senado kaugnay sa pagtutulak na maipasa ang Security of Tenure Bill.

 

Ayon kay Labor Assistant Secretary Joji Aragon, inatasan na ni Secretary Silvestre Bello III ang kanyang grupo upang magbigay ng lahat ng kinakailangang technical assistance sa mga senador kasunod ng pagpaplantsa sa bersyon ng nasabing batas sa seguridad sa trabaho.

 

Kasalukuyang nakasalang sa plenary interpellation ang Senate Bill No. 1826 o ang “Act Strengthening the Workers Right to Security of Tenure” na sponsored ni Senator Joel Villanueva, labor committee chairman.

 

“Kasunod ng utos at gabay ni Secretary Bello, narito kami upang bigyan ng kaukulang impormasyon ang mga mambabatas at si Senator Villanueva na siyang nag-sponsor upang maipasa ang nasabing batas. Umaasa kami sa mabilis na pagpasa nito patungo sa bicameral committee,” wika ni Aragon.

 

Noong Setyembre 21, nagpahayag na ng pagnanais si President Duterte na ma-certify as urgent ang SOT bill at hiniling ang agaran nitong pagkakapasa upang puksain ang iligal na uri ng labor contractualization sa bansa.

 

Nakatakdang amyendahan ng panukalang batas ang umiiral na Labor Code na nagbabawal sa labor-only contracting at iba pang probisyon na nagbibigay pahintulot sa iba pang contracting arrangement. Lilinawin rin ng pag-amyenda ang uri ng trabaho at aktibidad na maaari lamang idaan sa pangongontrata.

 

Iginigiit rin ng DOLE ang posisyon nito kaugnay sa kung ang trabaho na ginagawa ng isang manggagawa ay mayroong direktang koneksyon sa negosyo ng isang kumpanya tulad ng mga saleslady na namamasukan sa mall, sila ay dapat ng regular na empleyado ng principal/ employer.

 

Sa ilalim ng panukalang batas, isinasaad rin ang transition support program para sa job contracting kung saan dapat na mayroong three-month financial support para sa mga empleyado sa kondisyong sila ay sasailalim sa skills training o upgrading sa TESDA at iba pang accredited training institution habang wala pa silang trabaho.

 

Inaasahang uusad ang deliberasyon ng Senado para sa panukalang batas ngayong linggo.
