DOLE lauds Duterte action on endo bill

 

The labor department on Thursday lauded the move of President Duterte in certifying for urgent congressional action the security of tenure bill now pending in the Senate.

 

Labor Secretary Silvestre Bello III said the action of President Duterte is the fulfilment of his desire to end illegal contractualization and other forms of abusive employment practices.

 

“As soon as the Security of Tenure bill is passed by Congress, there will no longer be stumbling blocks in eliminating contractualization in enterprises. As it is, we believe that the measure contains the barest minimum provisions acceptable to both labor and management,” Bello said.

 

In fast-tracking the bill’s enactment, the President said the measure will strengthen workers’ security of tenure by prohibiting the practice of contractualization and labor-only contracting.

 

Once signed into law, the Security of Tenure Bill will amend and remove the ambiguities in the Labor Code, prohibit labor-only contracting, and provide penalties for its violation. The measure will also limit job contracting only to licensed and specialized services.

 

On Labor Day, the President signed an executive order strictly prohibiting illegal contracting and subcontracting practices to ensure job security. Based on the signed EO, the principal employer engaged in any arrangement shall be considered the direct employer of the workers.

 

Security of tenure refers to the right of employees not to be dismissed or removed without just or authorized cause and observance of procedural due process.

DOLE pinapurihan ang aksyon ni Duterte sa endo bill

 

Pinapurihan ng labor department nitong Huwebes si Presidente Duterte sa pag-sertipika nito na kailangang madaliin ng kongreso ang pag-aksiyon sa security of tenure bill na nakabinbin sa Senado.

 

Sinabi ni Labor Secretary Silvestre Bello III na ang ginawa ni President Duterte ay ang kaganapan ng kanyang hangarin na wakasan ang iligal na kontraktuwalisasyon at iba pang mapang-abusong gawain sa pag-empleo.

 

“Kapag agad na naipasa ng Kongreso ang Security of Tenure Bill, wala nang magiging balakid para wakasan ang kontraktuwalisasyon sa negosyo. Naniniwala kami na ang lahat ng hakbangin ay kinapapalooban ng minimum na probisyon na katanggap-tanggap sa parehong manggagawa at mamumuhunan,” ani Bello.

 

Upang mapabilis ang pagpapatupad sa batas, sinabi ng Presidente na palalakasin nito ang seguridad sa trabaho sa pagbabawal sa contractualization at labor-only contracting.

 

Kapag ito ay nalagdaan na para maging batas, aamyendahan at mabibigyan ng linaw ng Security of Tenure Bill ang nasa Labor Code, ipagbabawal ang labor-only contracting, at papatawan ng parusa ang anumang paglabag. Lilimitahan din ng nasabing hakbangin ang job contracting sa mga licensed at specialized services.

 

Noong Araw ng Paggawa, nilagdaan ni Presidente ang executive order na mahigpit na ipinagbabawal ang illegal contracting at subcontracting upang tiyakin ang seguridad sa trabaho. Batay sa nilagdaang EO, ang principal employer na nagpapatupad ng ganitong kasunduan ay matuturing na direktang employer ng manggagawa.

 

Ang security of tenure ay tumutukoy sa karapatan ng manggagawa na huwag tanggalin o maalis sa trabaho nang walang makatarungan o awtorisadong dahilan at kailangang sumailalim sa tamang pagdinig.
