Rules on work suspension, payment of wages during weather disturbances out

Employees who report for work during weather disturbances are entitled to full regular pay provided that they have worked for not less than six hours, said Labor Secretary Bienvenido E. Laguesma.

The directive was contained in Labor Advisory No. 17, Series of 2022 issued by Secretary Laguesma to guide private sector employers on the suspension of work and the appropriate payment of wages during inclement weather conditions and calamities.

Secretary Laguesma emphasized that private sector employers have the prerogative to suspend work to ensure the safety and health of their employees.

“Except as provided for by law or appropriate proclamation, employers in the private sector may, in the exercise of management prerogative and in coordination with the safety and health committee, safety officer, or any other responsible company officer, suspend work to ensure the safety and health of their employees during weather disturbances and similar occurrences,” said the labor chief.

If the company needs to continue with its operations, employees who will report for work are entitled to full regular pay provided that they have rendered work for not less than six hours.

Those who will render work for less than six hours shall only be entitled to the proportionate amount of the regular pay, without prejudice to existing company policy or practice more beneficial to the employee.

Laguesma also enjoined employers to provide extra incentives or benefits to employees who will report for work despite weather disturbances and similar occurrences.

On the other hand, employees who fail or refuse to work by reason of imminent danger resulting from inclement weather conditions shall not be subject to any administrative sanction.

However, they are also not entitled to regular pay, except when there is a favorable company policy, practice, or collective bargaining agreement granting payment of wages on the said day.

Those with accrued leave credits, meanwhile, may be allowed to utilize such benefits so that they will be compensated on the said day. END/aldm

Patakaran sa pagsususpinde ng trabaho, pagbabayad ng sahod kapag masama ang panahon

Ang empleyado na pumasok sa trabaho sa araw na masama ang panahon o may kalamidad ay may karapatang tanggapin ng buo ang kanilang regular na sahod sa kondisyon na sila ay nagtrabaho nang hindi bababa sa anim na oras. Ito ang pahayag ni Labor Secretary Bienvenido E. Laguesma.

Ang naturang direktiba ay nakapaloob sa Labor Advisory No. 17, Series of 2022 na inilabas ni Secretary Laguesma upang gabayan ang mga employer sa pribadong sektor tungkol sa pagsususpinde ng trabaho at ang nararapat na kabayaran na sahod tuwing masama ang panahon o may kalamidad.

Binigyang-diin ni Secretary Laguesma na ang mga employer sa pribadong sektor ay maaaring mag-suspinde ng trabaho upang matiyak ang kaligtasan at kalusugan ng kanilang mga empleyado.

“Maliban sa itinatakda ng batas o naaangkop na proklamasyon, ang mga employer sa pribadong sektor ay maaaring mag-suspinde ng trabaho para tiyakin ang kaligtasan at kalusugan ng kanilang empleyado tuwing may kalamidad o kahalintulad na pangyayari, gamit ang kanilang karapatan sa pamamahala at sa pakikipag-ugnayan sa komite sa kaligtasan at kalusugan, safety officer, o sinumang responsableng opisyal ng kompanya,” pahayag ng kalihim ng paggawa.

Kung kailangan ng kumpanya na ipagpatuloy ang kanilang operasyon, ang mga empleyado na papasok sa trabaho ay may karapatan tanggapin ng buo ang kanilang regular na suweldo,  sa kondisyon na sila ay nag-trabaho nang hindi bababa sa anim na oras.

Ang mga nagtrabaho nang wala sa anim na oras ay tatanggap lamang ng proporsyonal na halaga ng kanilang regular na sahod, nang walang pagkiling sa umiiral na patakaran o polisiya ng kumpanya na mas kapaki-pakinabang sa empleyado.

Hinikayat din ni Laguesma ang mga employer na magbigay ng dagdag na insentibo o benepisyo sa mga empleyadong papasok sa sa trabaho sa kabila ng masamang panahon o kahalintulad na sitwasyon.

Sa kabilang banda, ang mga empleyadong hindi nakapasok o tumangging pumasok sa trabaho dahil sa napipintong panganib dulot ng masamang panahon ay hindi dapat sumailalim sa anumang administratibong parusa.

Gayunpaman, hindi sila maaaring tumanggap ng kanilang regular na sahod, maliban lamang kung mayroong paborableng patakaran ang kumpanya, o collective bargaining agreement (CBA) na nagtatakda ng pagbibigay ng sahod para sa nasabing araw.

Samantala, ang mga may naipong mga leave credit ay maaaring payagang gamitin ang naturang benepisyo upang sila ay mabayaran sa nasabing araw. END/aldm/gmea
