National Conciliation and Mediation Board (NCMB) OIC-Executive Director Shirley Pascual reported to Secretary Rosalinda Dimapilis-Baldoz the settlement of the preventive mediation case involving Liberty Paper Inc., in Valenzuela City and its workers’ union, Samahan ng Manggagawa sa Liberty Paper, Inc., with management ensuring the health and safety condition of its employees.

 

“I am pleased to report that the parties in the dispute, after scheduled conciliation-mediation, decided to settle the labor dispute through an agreement that ensure the health and safety of the workers in their workplaces,” said Pascual.

 

Pascual said RCMB-NCR Conciliator-Mediator Estelita S. Bautista facilitated the settlement.

 

Secretary Baldoz, citing the report, said that this will be good for the management and workers of the paper mill company. “An amicable settlement is always beneficial. It prevents prolonged legal conflict which is hurtful to industrial peace and harmony,” she said.

 

On 18 September 2015, the union filed a preventive mediation case for unfair labor practice, specifically transfer of employees to other department, health and safety condition of the workers, and issuance of ITR forms.

 

After a series of conference, the management and union have amicably settled the labor disputes. The agreements are as follows:

 

• The management shall advise the union if there will be new measures to be implemented;

 

• A union representative shall be requested during inspections; and

 

• The management shall release the BIR forms of the workers.

 

Liberty paper, Inc. is a paper mill company located in Valenzuela City. It has 120 employees and represented by its human resource officer, Laura Balce. Samahan ng Mangagagwa sa Liberty Paper, Inc., on the other hand, is an affiliate of Association of Genuine Labor Organizations (AGLO). It is the sole and exclusive bargaining agent of its 45 union members. It is headed by Manuel Penaloza.
