OFWs in Korea given 1-year extension of stay

The period of stay and employment of overseas Filipino workers in Korea who are under the Employment Permit System (EPS) and whose contract term expires within the period 13 April 2021 to 31 December 2021 will be extended to one year effective 13 April 2021.

In a report to Secretary Silvestre Bello III, Labor Attaché Maya Valderrama of the Philippine Overseas Labor Office in Korea cited the recent issuance from Korea’s Ministry of Employment and Labor (MOEL) and the Ministry of Justice (MOJ) on the relevant amendment to the Act on Employment of Foreign Workers which extends the stay of foreign workers given the prevailing condition brought about by the pandemic.

The issuance provides that the stay and employment period of foreign workers (E-9 and H-2) under the EPS and whose employment period (3 years or 4 years and 10 months) expires from 13 April 2021 to 31 December 2021, is extended for one (1) year.

According to Valderrama, the MOEL expects that this measure will resolve the difficulties of workers entering and leaving the country during the pandemic and the manpower shortage of small and medium-sized companies.

Bello thanked the Seoul government for the move that will benefit hundreds of workers in Korea.

“We welcome this unprecedented employment measure extended by the Republic of Korea (ROK) to our EPS workers especially during this time of the pandemic. The preservation of jobs of our OFWs everywhere in the world is our primordial concern, and this development highlights the value of our 15 years of continuing bilateral cooperation on labor with the ROK,” Bello said.

According to the guideline, the extension period of stay and employment also applies to EPS workers who have been given a 50-day visa extension by Korea authorities, provided that the extended period also falls within the period 13 April 2021 to 31 December 2021. This extension of stay and employment period of eligible foreign workers will be automatically implemented by the ROK effective 13 April 2021 through applications submitted by the respective employers.

The EPS is a government-to-government hiring system that allows Korean employers to legally employ foreign workers in cases of unavailability in the local workforce. It is managed by the Philippine Overseas Employment Administration as the sending agency with the Human Resource Development Service in Korea as its counterpart.

The Philippines was the first sending country that signed the Memorandum of Understanding on EPS with ROK in 2004. # # #

OFW pinalawig ng 1-taon ang pananatili sa Korea

Pinalawig ng isang taon ang pananatili at pagtatrabaho ng mga overseas Filipino worker (OFW) sa Korea na nasa ilalim ng Employment Permit System (EPS) na ang kontrata ay mawawalan ng bisa sa panahon ng 13 Abril 2021 hanggang 31 Disyembre 2021 at ito ay epektibo ng 13 Abril 2021.

Sa ulat kay Labor Secretary Silvestre Bello III, sinabi ni Labor Attaché Maya Valderrama ng Philippine Overseas Labor Office sa Korea na sa pinakahuling issuance mula sa Ministry of Employment and Labor (MOEL) at ng Ministry of Justice (MOJ) ng Korea ukol sa inamyendahang Act on Employment of Foreign Workers, pinalalawig sa pananatili ang mga banyagang manggagawa dahil sa kasalukuyang kondisyon dulot ng pandemya.

Nakasaad sa issuance na palalawigin pa ng isang (1) taon ang panahon ng pananatili at pagtatrabaho ng banyagang manggagawa (E-9 and H-2) sa ilalim ng EPS at iyong kontrata ng pagtatrabaho (3 taon o 4 na taon at 10 buwan) na magkakawalang-bisa mula 13 Abril 2021 hanggang 31 Disyembre 2021.

Ayon kay Valderrama, inaasahan ng MOEL na sa ganitong paraan mareresolbahan ang problema ng manggagawa sa pagpasok at paglabas ng bansa sa panahon ng pandemya at ang kakulangan ng manggagawa sa small at medium-sized company.

Pinasalamatan ni Bello ang pamahalaan ng Seoul ang pagbabagong ito para sa kapakinabangan ng banyagang manggagawa sa Korea.

“Ipinagpapasalamat namin ang bagong patakaran sa empleo na ipinagkaloob ng Republic of Korea (ROK) sa ating manggagawa na nasa ilalim ng EPS lalo na ngayong panahon ng pandemya. Ang pangangalaga sa trabaho ng ating OFW sa buong mundo ay pangunahin nating layunin, at ipinapakita nito ang kahalagahan ng 15 taong tuloy-tuloy na bilateral cooperation kasama ang ROK,” wika ni Bello.

Nakasaad din sa patakaran na sakop ang mga manggagawa na nasa ilalim ng EPS na nabigyan ng 50-araw visa extension ng awtoridad ng Korea, kung ito ay nasa loob ng 13 Abril 2021 hanggang 31 Disyembre 2021.  Ang pagpapalawig sa pananatili at pagtatrabaho ng karapat-dapat na banyagang manggagawa ay agad ipatutupad ng ROK at magkakabisa ng 13 Abril 2021 sa pamamagitan ng apilikasyong isinumite ng kanilang employer.

Ang EPS ay isang government-to-government hiring system na nagpapahintulot sa Korean employer na legal na mag-employ ng banyagang manggagawa sa pagkakataon na walang makuhang manggagawang lokal. Ito ay nasa pangangasiwa ng Philippine Overseas Employment Administration bilang sending agency katuwang ang Human Resource Development Service ng Korea.

Ang Pilipinas ang unang bansa na lumagda ng Memorandum of Understanding sa EPS sa ROK noong 2004. # # #
