Observe holiday pay, employers told

The labor department called on employers and business owners to observe the proper pay rules during the special non-working and regular holidays in August.

Labor Secretary Silvestre Bello III said despite the imposition of community quarantines across the country, private companies that require their workers to report for work are obliged to observe the proper payment of wages during the holidays under the Labor Code.

Bello issued Labor Advisory No. 15, series of 2021 for proper payment of wages on August 21, 2021, declared a special non-working holiday under Proclamation No. 1107; and on August 30, 2021, National Heroes Day, a regular holiday.

Bello said for August 21, Ninoy Aquino Day, the following pay rules shall apply:

If the employee did not work, the “no work, no pay” principle shall apply, unless there is a company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.

For work done during the special day, employees shall be paid an additional 30 percent of their basic wage on the first eight hours of work [(basic wage x 130%) + COLA].

For work done in excess of eight hours (overtime work), employees shall be paid an additional 30 percent of their hourly rate on the said day [hourly rate of the basic wage x 130% x 130% x number of hours worked].

For employees who work on a special holiday that falls on his/her rest day, he/she shall be paid an additional 50 percent of his/her basic wage on the first eight hours of work [(basic wage x 150%) + COLA].

For overtime work on a special day that also falls on their rest day, employees shall be paid an additional 30 percent of their hourly rate on the said day [Hourly rate of the basic wage x 150% x 130% x number of hours worked].

Further, the said labor advisory also prescribes the following pay rules for the regular holiday on August 30 (National Heroes Day):

Employees who did not work shall be paid 100% of their wage for that day [(basic wage + COLA) x 100%], while for work done by employees during the regular holiday, they shall be paid 200% of their wage for the first eight hours [(basic wage + COLA) x 200%].

For overtime work (work done in excess of eight hours), employees shall be paid an additional 30% of their hourly rate [Hourly rate of the basic wage x 200% x 130% x number of hours worked].

On the other hand, employees who work on a regular holiday that falls on their rest day shall be paid an additional 30% of their basic wage of 200% or [(basic wage + COLA) x 200%] + [30% (basic wage x 200%)].

Employees who render overtime on a regular holiday that falls on their rest day shall be paid an additional 30% of their hourly rate on said day [Hourly rate of the basic wage x 200% x 130% x 130% x number of hours worked]. ###

Employer pinaalalahan, sundin tamang pasahod tuwing piyesta-opisyal

Nanawagan ang labor department sa mga employer at may-ari ng negosyo na sundin ang wastong patakaran sa pagbabayad ng sahod ng kanilang mga mangggagawa sa special non-working at regular holiday ngayong Agosto.

Sinabi ni Labor Secretary Silvestre Bello III na sa kabila ng pagpapatupad ng community quarantine sa buong bansa, kailangang sundin ng mga pribadong kompanya, na nag-aatas sa kanilang mga manggagagawa na magtrabaho, ang pagbibigay ng tamang pasahod tuwing piyesta-opisyal, sa ilalim ng Labor Code.

Ipinalabas ni Bello ang Labor Advisory No. 15, series of 2021 para sa tamang pasahod sa Agosto 21, 2021, na dineklarang special non-working holiday sa ilalim ng Proclamation No. 1107; at sa Agosto 30, 2021, Araw ng mga Bayani, isang regular holiday.

Sinabi ni Bello na para sa Agosto 21, Ninoy Aquino Day, ang mga sumusunod na patakaran ang dapat sundin:

Kung ang empleyado ay hindi nagtrabaho, ang “no work, no pay” policy  ang dapat sundin, maliban na lamang kung ang kompanya ay may polisiya o collective bargaining agreement (CBA) na nagbibigay ng sahod para sa nasabing araw.

Kung nagtrabaho sa nasabing araw, dapat bayaran ang empleyado ng karagdagang 30% ng kanyang arawang sahod sa unang walong oras ng trabaho [(arawang sahod x 130%) + COLA].

Para sa trabahong ginampanan ng higit sa walong oras (overtime work), dapat bayaran ang empleyado ng karagdagang 30% ng kanyang orasang kita sa nasabing araw [orasang kita ng kanyang arawang sahod x 130% x 130% x bilang ng oras na trinabaho].

Para sa mga empleyadong nagtrabaho ng special holiday at ito rin ang araw ng kanyang pahinga, siya ay babayaran ng karagdagang 50% ng kanyang arawang kita sa unang walong oras ng trabaho [(arawang sahod x 150%) + COLA].

Para naman sa overtime work ng special holiday at ito rin ay araw ng kanyang pahinga, ang empleyado ay dapat bayaran ng karagdagang 30% ng kanyang orasang kita sa nasabing araw. [Orasang kita ng kanyang arawang sahod x 150% x 130% x bilang ng oras na trinabaho].

Dagdag dito, itinakda rin ng Labor Advisory ang mga sumusunod na alituntunin sa pasahod para sa regular holiday ng Agosto 30 (Araw ng mga Bayani):

Ang empleyado na hindi nagtrabaho ay babayaran ng 100% ng kanyang sahod sa nasabing araw [(arawang sahod + COLA) x 100%], kung nagtrabaho ang empleyado ng regular holiday, dapat siyang bayaran ng 200% ng kanyang sahod para sa unang walong oras [(arawang sahod + COLA) x 200%].

Para sa overtime work (ginampanang trabaho na higit sa walong oras), dapat bayaran ang empleyado ng karagdagang 30% ng kanyang orasang kita [orasang kita ng arawang sahod x 200% x 130% x bilang ng oras na trinabaho].

Sa kabilang banda, ang empleyado na nagtrabaho ng regular holiday at ito rin ay araw ng kanyang pahinga ay dapat barayan ng karagdagang 30% ng kanyang arawang sahod na 200% o [(arawang sahod + COLA) x 200%] + [30% (arawang sahod x 200%)].

Ang empleyado na nag-overtime ng regular holiday at ito rin ay araw ng kanyang pahinga ay dapat bayaran ng karagdagang 30% ng kanyang orasang kita sa nasabing araw [orasang kita ng arawang sahod x 200% x 130% x 130% x bilang ng oras na trinabaho]. ###
