Household service workers may enjoy more leave benefits on top of the provisions in the Domestic Workers’ Act or the Kasambahay law.

This according to Secretary Silvestre Bello III in a Labor Advisory he issued which identified three other laws that entitle kasambahays to special leave benefits.

Under the advisory, household service workers who meet the requirements for Solo Parent Leave (RA 8972), Special Leave Benefit for Women under the Magna Carta for Women (RA 9710), and Violence against Women and their Children (VAWC) Leave (RA 9262), can apply for leave benefits provided by laws.

The leave entitlement are aside from the five days service incentive leave granted under the Labor Code.

The Solo Parent Leave under RA 8972 can be availed of by domestic household workers if they need to perform parental duties and responsibilities where physical presence is required.

Meanwhile, the Special Leave Benefit for Women under the Magna Carta for Women, or RA 9710, provides two weeks and up to 60 days (or 2 months) of paid leave. This is applicable to women workers who have a gynecological disorder that would require surgical procedures, such as dilatation and curettage or those involving female reproductive organs as well as gynecological surgeries, such as hysterectomy, ovariectomy, and mastectomy.

Also, the Kasambahays who are victims of physical, sexual, and psychological violence, as well as economic abuse, are entitled to avail of a 10-day paid leave under Republic Act No. 9262.

“Our household service workers shall be entitled to all the rights and benefits granted under RA 10361, or Batas Kasambahay, as amended unless expressly provided. The employers are not prohibited from granting such other benefits in addition to the minimum requirements of the law,” Bello said.

Bello also encouraged healthy dialogue between the Kasambahay and their employer to promote a harmonious working environment and settle disputes. RA 10361 provides benefits for household service workers such as a standard minimum wage, among others.

The Kasambahay law, which is considered as a landmark labor and social legislation, also entitles household service workers to mandatory social benefits such as SSS, Philhealth, and Pag-Ibig, 13th-month pay, five days annual service incentive leave, and a one whole day uninterrupted weekly rest period.

Dagdag benepisyo sa leave para sa kasambahay

Makakakuha ng karagdagang benepisyo sa leave ang mga household service workers liban pa sa mga itinatakdang probisyon ng Domestic Workers’ Act o Batas Kasambahay.

Ayon sa inisyung Labor Advisory ni Secretary Silvestre Bello III, tatlong karagdagang batas ang binanggit niya na nagbibigay sa mga kasambahay ng special leave benefits.

Sa ilalim ng advisory, ang mga household service workers na pasok sa requirements para sa Solo Parent Leave (RA 8972), Special Leave Benefit for Women sa ilalim ng Magna Carta for Women (RA 9710), at Violence against Women and their Children (VAWC) Leave (RA 9262), ay maaaring mag-aplay para sa nasabing mga leave benefit na isinasaad ng batas.

Ang mga nasabing benepisyo sa leave ay liban pa sa limang araw na service incentive leave na isinasaad sa ilalim ng Labor Code.

Ang mga domestic household workers ay maaaring mag-aplay para sa Solo Parent Leave sa ilalim ng RA 8972 kung sila ay magsasagawa ng parental duties and responsibilities kung saan kinakailangan ang kanilang pisikal na presensya.

Samantala, ang Special Leave Benefit para sa mga kababaihan sa ilalim ng Magna Carta for Women, o RA 9710 ay nagbibigay ng dalawang linggo hanggang 60 araw (o 2 buwan) ng bayad na leave. Angkop rin ito sa mga babaeng manggagawa na mayroong gynecological disorder at nangangailangan ng surgical procedure tulad ng dilatation at curettage o mga operasyon sa female reproductive organ at iba pang gynecological surgery tulad ng hysterectomy, ovariectomy, at mastectomy.

Ang mga kasambahay rin na biktima ng physical, sexual, at psychological violence, at economic abuse, ay maaaring mag-aplay para sa 10-araw na paid leave sa ilalim ng Republic Act No. 9262.

“Ang ating mga household service worker ay may karapatang makuha ang mga benepisyo sa ilalim ng RA 10361, o Batas Kasambahay. Ang mga employer naman ay hindi pinagbabawalan na magbigay ng karagdagang benepisyo liban pa sa minimum requirement ng batas,” wika ni Bello.

Hinikayat rin ni Bello na magkaroon ng maayos na dayalogo sa pagitan ng kasambahay at kanilang employer para maresolba ang anumang hindi pagkakaintindihan.

Isinasaad sa RA 10361 ang mga benepisyo para sa mga household service worker tulad ng standard minimum wage, at iba pa.

Ang Batas Kasambahay law, na itinuturing na landmark labor and social legislation, ay nagtatakda rin sa household service workers na mabigyan sila ng mandatory social benefit tulad ng SSS, Philhealth, at Pag-Ibig, 13th-month pay, limang araw na annual service incentive leave, at isang buong araw na hindi naaabalang rest day sa loob ng isang linggo.
