Mama-o gets fresh rebuke

The Secretary of the Department of Migrant Workers (DMW) cannot impose any policy over the government agencies that will be consolidated under the DMW law pending the full constitution of the new department.

In a fresh rebuke of DMW Secretary Abdullah Mama-o, Executive Secretary Salvador Medialdea upheld the position of Labor Secretary Silvestre Bello III in maintaining the status quo, including the suspension of processing of newly hired household service workers for deployment to the Kingdom of Saudi Arabia.

In a memorandum issued by the Executive Secretary last week, Medialdea again advised Mama-o that the DMW has yet to be fully constituted and therefore cannot impose any policy on any agency that the new department will subsume later.

Medialdea was referring to DMW Department Order No. 4, Series of 2022 dated April 25, which lifts the ban on deployment to the Kingdom of Saudi Arabia (KSA), and DMW Advisory No. 3, Series of 2022 dated April 18, which enumerates the insurance providers accredited by the Insurance Commission to provide enhanced insurance coverage to OFWs.

“Considering that the DMW has not been constituted yet, the DMW Secretary may not impose any policy on the government entities/agencies enumerated in Section 19 of RA No. 11641, since the said entities/agencies continue to exist separately until the DMW is constituted,” the memorandum states.

Under Section 23 of the said law, the DMW shall not be constituted without an appropriation in the 2023 General Appropriations Act, an effective implementing rules and regulations, and a staffing pattern.

In a separate letter to Mama-o, Medialdea reiterated that the implementing rules and regulations submitted by the Transition Committee was approved by the President and was cleared with him prior to its publication.

Bello earlier clarified that the Department of Labor and Employment and the Philippine Overseas Employment Administration Governing Board did not impose a ban on the deployment of migrant workers to KSA. Instead, the labor secretary only directed the Philippine Overseas Labor Offices in Riyadh, Al Khobar, and Jeddah to temporarily suspend the verification of employment documents of newly-hired household service workers bound for KSA. Mama-o muling pinaalalahanan 

Hindi maaaring magbigay ang Kalihim ng Department of Migrant Workers (DMW) ng anumang patakaran sa mga ahensya ng pamahalaan na pagsasama-samahin sa ilalim ng batas ng DMW habang hindi pa ganap na nabubuo ang konstitusyon ng bagong kagawaran.

Sa panibagong pagpapaalala kay DMW Secretary Abdullah Mama-o, kinatigan ni Executive Secretary Salvador Medialdea ang posisyon ni Labor Secretary Silvestre Bello III na panatilihin ang status quo, kabilang ang pagsuspinde sa pagproseso ng mga bagong tanggap na household service worker para i-deploy sa Kingdom of Saudi Arabia (KSA).

Sa isang memorandum na inilabas ng Executive Secretary noong nakaraang linggo, muling pinaalala ni Medialdea kay Mama-o na hindi pa ganap na nabubuo ang DMW, kung kaya’t  hindi pa siya maaaring magbigay ng anumang patakaran sa alinmang ahensya na sasailalim sa bagong kagawaran.

Tinutukoy ni Medialdea ang DMW Department Order No. 4, Series of 2022 na may petsang Abril 25, na nag-aalis sa deployment ban sa Kingdom of Saudi Arabia (KSA), at ang DMW Advisory No. 3, Series of 2022 na may petsang Abril 18, kung saan nakatala ang insurance provider na may akreditasyon sa Insurance Commission para sa mas mahusay na insurance coverage sa mga OFW.

“Dapat isaalang-alang na hindi pa ganap na buo ang DMW, kaya’t ang Kalihim ng DMW ay hindi pa maaaring maglabas ng anumang polisiya sa mga tanggapan o ahensiya ng pamahalaan na nakasaad sa Section 19 ng RA No. 11641, dahil ang mga nasabing tanggapan o ahensiya ay magkahiwalay pa ring umiiral hanggang ang DMW ay ganap nang nabuo,” nakasaad sa memorandum.

Sa ilalim ng Section 23 ng nasabing batas, ang DMW ay hindi ganap na maitatatag kung walang nakalaang pondo sa 2023 General Appropriations Act, implementing rules and regulation (IRR), at staffing pattern.

Sa hiwalay na liham kay Mama-o, muling ipinaalala ni Medialdea na inaprubahan ng Pangulo ang IRR na isinumite ng Transition Committee at hiningan ng pahintulot sa kanya bago ito ipinalathala.

Una nang nilinaw ni Bello na hindi nagpalabas ang Department of Labor and Employment at ang Philippine Overseas Employment Administration Governing Board ng deployment ban para sa mga migranteng manggagawa sa KSA. Sa halip, inatasan lamang ng labor secretary ang Philippine Overseas Labor Office sa Riyadh, Al Khobar at Jeddah na pansamantalang suspindihin ang beripikasyon ng mga dokumento sa mga bagong tanggap na household service worker na patungo sa KSA.
