Maintain status quo in POEA – Bello

Labor Secretary Silvestre Bello III has directed all personnel of the Philippine Overseas Employment Administration (POEA) to observe the status quo in the performance of their duties and responsibilities until the Department of Migrant Workers (DMW) is fully constituted.

Bello issued the directive amid contrary positions taken by some quarters that “have caused confusion and disruption of public service to the detriment of migrant workers.”

In a memorandum, Bello also authorized POEA Administrator Bernard Olalia to issue the appropriate orders to carry out his directive in the interest of the service and to ensure the orderly operations of POEA.

Bello stressed that the DMW is yet to be fully constituted until there is an appropriation of the DMW in the 2023 General Appropriations Act; effective implementing rules and regulations; and a staffing pattern.

Citing the conflicting positions on the constitution of DMW, Bello pointed to the Administrative Code of 1987 stating that all disputes, claims, and controversies, solely between or among the departments, bureaus, offices, agencies, and instrumentalities of the national government shall be administratively settled or adjudicated by the Secretary of Justice, as the Attorney-General of the national government.

“Thus, it is of utmost importance that the status quo be maintained pending the issuance of the Justice Secretary of his ruling or decision, which shall be conclusive and binding on all parties concerned,” Bello said.

The Blas F. Ople Policy Center has sought the opinion of Justice Secretary Menardo Guevarra on the matter.

Meanwhile, Executive Secretary Salvador Medialdea said the President has been presented with both the implementing rules and regulations submitted by the Transition Committee and the DMW Secretary.

It can be recalled that the Transition Committee has submitted to the Office of the President the implementing rules and regulations, which was signed by the members of the Committee, except the DMW Secretary. The DMW Secretary, on the other hand, signed his version of the implementing rules and regulations, which was published on April 6.

In recognition of the authority of the Transition Committee to formulate the implementing rules and regulations of Republic Act 11641, Medialdea issued a memorandum on April 18 informing that the President “interposes no objection to the submitted IRR and has cleared its immediate publication.” END/aldm

Panatilihin ang status quo sa POEA – Bello

Inatasan ni Labor Secretary Silvestre Bello III ang lahat ng tauhan ng Philippine Overseas Employment Administration (POEA) na panatilihin ang status quo sa pagganap ng kanilang mga tungkulin at responsibilidad hanggang sa ganap na mabuo ang Department of Migrant Workers (DMW).

Ipinahayag ni Bello ang direktiba sa gitna ng mga salungat na posisyon mula sa ilang grupo na “nagdulot ng kalituhan at pagkagambala sa serbisyo publiko ng mga migranteng manggagawa.”

Sa isang memorandum, binigyang-pahintulot ni Bello si POEA Administrator Bernard Olalia na maglabas ng kaukulang utos upang maisakatuparan ang kanyang direktiba para sa pagbibigay ng serbisyo at upang matiyak ang maayos na operasyon ng POEA.

Binigyang-diin ni Bello na ganap na mabubuo ang DMW sa sandaling ang nakalaang pondo nito ay nakasama na sa 2023 General Appropriations Act; epektibong pagpapatupad ng mga tuntunin at regulasyon; at mayroon nang pinagtibay na staffing pattern.

Sa pagbanggit sa mga magkasalungat na posisyon sa konstitusyon ng DMW, tinukoy ni Bello ang Administrative Code of 1987 na nagsasaad na ang lahat ng mga hindi pagkakaunawaan, paghahabol, at kontrobersya, sa pagitan ng mga kagawaran, kawanihan, opisina, ahensya, at instrumentalidad ng pambansang pamahalaan ay dapat administratibong naayos o hinatulan ng Justice Secretary, bilang Attorney-General ng pambansang pamahalaan.

“Kaya, napakahalaga na mapanatili ang status quo habang nakabinbin ang pagpapalabas ng Justice Secretary ng kanyang desisyon, na magiging konklusibo at may bisa sa lahat ng partidong may kaugnayan,” pahayag ni Bello.

Hiniling ng Blas F. Ople Policy Center ang opinyon ni Justice Secretary Menardo Guevarra ukol sa usapin.

Samantala, sinabi ni Executive Secretary Salvador Medialdea na ipinakita sa Pangulo ang parehong implementing rules and regulations na isinumite ng Transition Committee at ng Kalihim ng DMW.

Matatandaan na isinumite ng Transition Committee sa Tanggapan ng Pangulo ang implementing rules and regulations, na may lagda ng mga miyembro ng Committee, maliban sa Kalihim ng DMW. Sa kabilang banda, nilagdaan ng Kalihim ng DMW ang kanyang bersyon ng pagpapatupad ng mga patakaran at regulasyon, na inilathala noong Abril 6.

Bilang pagkilala sa kapangyarihan ng Transition Committee na bumalangkas sa implementing rules and regulations ng Republic Act 11641, naglabas si Medialdea ng isang memorandum noong Abril 18 kung saan ipinapaalam na ang Pangulo ay “walang pagtutol sa isinumiteng IRR at pinahintulutan ang agarang publikasyon nito.” END/aldm/gmea
