Guidelines on unemployment insurance certification out

For a more efficient implementation of the Social Security System’s involuntary separation benefit, the Department of Labor and Employment released the guidelines on the issuance of certification to involuntarily laid-off employees who wish to apply for unemployment insurance.

Labor Secretary Silvestre Bello III signed last week Department Circular No. 01, series of 2019 that spells out the guidelines on the issuance of DOLE certification as a requirement for availment by eligible SSS-member employees, including kasambahay and overseas Filipino workers, who were involuntarily separated from work.

The certification must be secured from the DOLE field or provincial office where applicants reside or from where their company is located.

For OFWs, they can file their application at the Philippine Overseas Labor Office located in the areas where their employers operate or at their residences’ nearest DOLE field or provincial office.

Applicants must bring one valid identification card; a copy of the notice of termination issued by the employer, or if not available a duly notarized affidavit of termination of employment.

To qualify for the grant of unemployment benefit, the employee, including kasambahay, and OFW, should not be over 60 years of age at the time of involuntary separation; has paid at least 36 monthly contributions, 12 of which should be in the 18-month period immediately preceding the month of involuntary separation; and has no settled unemployment benefit within the last three years prior to the date of involuntary separation.

The workers must have been involuntarily separated due to “authorized causes,” such as the installation of labor-saving devices; redundancy; retrenchment or downsizing; closure or cessation of operation; or disease/illness of the employee whose continued employment is prohibited by law or is prejudicial to his or her co-employees’ health.

Also eligible to file are those who lost jobs due to “just causes” as stated under Article 300 (285) of P.D. No. 442 or the Labor Code of the Philippines; or due to an economic downturn, natural or human-induced calamities/disasters, and other similar cases as may be determined by the DOLE and SSS.  # # #GSR

DOLE naglabas ng patakaran ukol sa unemployment insurance certification 

Sa layunin na maging maayos ang implementasyon ng involuntary separation benefit ng Social Security System, naglabas ang Department of Labor and Employment ng patakaran sa pagbibigay ng sertipikasyon sa mga involuntary laid-off employee na nagnanais makatanggap ng unemployment insurance.

Nilagdaan ni Labor Secretary Silvestre Bello III noong nakaraang linggo ang Department Circular No. 01, series of 2019, na naglalatag ng patakaran sa pagbibigay ng DOLE certification na isa sa mga kinakailangang dokumento ng lehitimong miyembro ng SSS, kabilang ang mga kasambahay at overseas Filipino worker, na natanggal sa trabaho nang hindi nila kagustuhan.

Makukuha ang certification mula sa DOLE field o provincial office kung saan nakatira ang aplikante o sa lugar na kaniyang pinagtatrabahuhan.

Para sa mga OFW, maaari nilang isumite ang kanilang aplikasyon sa Philippine Overseas Labor Office sa lugar kung nasaan ang kanilang employer o sa lugar na kanilang tinitirhan na malapit sa DOLE field o provincial office.

Dapat dalhin ng aplikante ang isang balidong identification card; kopya ng notice of termination na inisyu ng employer o duly notarized affidavit of termination of employment, kung wala ito.

Para maging kwalipikado sa unemployment benefit, ang manggagawa, kabilang ang mga kasambahay at OFW, ay hindi dapat lalampas sa 60 taong gulang ang edad sa panahon nang sila ay matanggal sa trabaho; nakapagbayad nang hindi bababa ng 36 buwanang kontribusyon at 12 sa mga ito ay nasa 18-buwan panahon makalipas ang buwan nang matanggal sa trabaho; at hindi nakatanggap ng unemployment benefit sa loob ng huling tatlong taon bago ang petsa ng pagkakatanggal sa trabaho.

Ang manggagawa ay dapat na natanggal sa trabaho dahil sa “awtorisadong dahilan,”  tulad ng paglalagay ng labor-saving device; redundancy, retrenchment o downsizing, pagsasara o pagtigil ng operasyon; o pagkakasakit ng empleyado at ang kanyang patuloy na pagtatrabaho ay pinagbabawal ng batas o makakasama sa kalusugan ng kanyang kapwa-manggagawa.

Maaari ring mag-aplay ang mga nawalan ng trabaho dahil sa “makatarungang dahilan” batay sa nakasaad sa Article 300 (285) ng P.D. No. 442 o ang Labor Code of the Philippines; o dahil sa paghina ng ekonomiya, kalamidad/sakuna, at iba pang katulad na kaso batay sa pagkakapasya ng DOLE at SSS.
