The labor department has underscored the effectiveness of Grievance Machinery (GM) in workplaces in the peaceful settlement of labor disputes and in reinforcing labor-management relations.

Citing a report from the National Conciliation and Mediation Board (NCMB), Labor Secretary Silvestre Bello III said “Grievance machinery provides peaceful resolution to labor disputes in a systematic manner. It serves as communication channel for the parties, and gives opportunity for workers to voice their concerns.”

The NCMB report said of the existing 3,820 grievance machineries nationwide, 3,707 or 97 percent indicated no Actual Strike/Lockouts, Notices of Strike/Lockout, and Preventive Mediation or Voluntary Arbitration cases since January 2018.

Grievance machinery is intended to promote friendly dialogue between labor and management as a means of maintaining industrial peace.

Under the alternative dispute settlement mechanism, every employee has the opportunity to be heard to address their dissatisfaction which affects the employee’s morale and reduce their efficiency at work.

Article 260 of the Labor Code requires parties to establish grievance machinery for the resolution of grievances arising from the interpretation or implementation of a collective bargaining agreement or the interpretation or enforcement of company personnel policies.

As of June 30, 2018, DOLE has enhanced the operations of 1,177 GMs nationwide. Aside from the grievance machinery, the labor department has also enhanced the operation of Labor Management Cooperations (LMCs) in companies through convergence program with the National Wages and Productivity Commission, Occupational Safety and Health Center, Employees’ Compensation Commission, and Bureau of Workers with Special Concerns.

Binigyang-halaga ng labor department ang pagiging epektibo ng Grievance Machinery para sa mapayapang pagsasaayos ng hindi pagkakaunawaan sa lugar-paggawa at ang pagpapatibay ng relasyon sa pagitan ng manggagawa at mamumuhunan.

Sa ulat ng National Conciliation and Mediation Board (NCMB), sinabi ni Labor Secretary Silvestre Bello III na ang “Grievance machinery ay isang sistematikong pamamaraan para sa mapayapang pag-resolba ng di-pagkakaunawaan sa paggawa. Ito ay nagsisilbing daan ng komunikasyon para sa mga partido, at nagbibigay oportunidad para sa mangggagawa upang ipahayag ang kanilang mga alalahanin.”

Ayon sa NCMB, sa kasalukuyang 3,820 grievance machinery sa buong bansa, 3,707 o 97 porsiyento ang walang naitalang kaso ng Actual Strike/Lockouts, Notices of Strike/Lockout, at Preventive Mediation o Voluntary Arbitration mula Enero 2018.

Nilalayon ng grievance machinery ang maayos na dayalogo sa pagitan ng manggagawa at mamumuhunan bilang isang paraan upang mapanatili ang kaayusan sa industriya.

Sa ilalim ng alternative dispute settlement mechanism, ang bawat empleyado ay may oportunidad na marinig upang tugunan ang kanilang mga reklamo na nakakaapekto sa moral ng empleyado at nakababawas sa kanilang pagiging produktibo sa trabaho.

Sa ilalim ng Article 260 ng Labor Code, kinakailangang magtatag ang partido ng grievance machinery para sa pagresolba ng mga reklamo na nagmumula sa interpretasyon o implementasyon ng collective bargaining agreement o ang interpretasyon o pagpapatupad ng company personnel policy.

Nitong Hunyo 30, 2018, pinalakas ng DOLE ang operasyon ng 1,177 GM sa buong bansa.

Maliban sa grievance machinery, pinalakas din ng labor department ang operasyon ng Labor Management Cooperation sa mga kompanya sa pamamagitan ng convergence program ng National Wages and Productivity Commission, Occupational Safety and Health Center, Employees’ Compensation Commission, at Bureau of Workers with Special Concerns.
