Employers urged to uphold security of tenure

Employers in the private sector were urged by the labor department to uphold the rights of the Filipino workers to security of tenure and help the government to curb illegal forms of contractualization or ‘endo.’

In a luncheon meeting with the officers and members of the European Chamber of Commerce in the Philippines (ECCP) in Makati Shangri-la, Makati City, Labor Secretary Silvestre Bello III said he is optimistic that President Rodrigo Duterte will sign the Security of Tenure (SOT) bill.

The SOT bill is one of DOLE’s priority legislative measures that has been certified as urgent by the President. It aims to amend the Labor Code on the prohibition of labor-only contracting and other provisions that allow contracting arrangements.

“Some employers take advantage of the word ‘probationary employees’. They hire workers who are supposed to undergo the six-month probationary status. However, the workers are terminated before the end of the said period. That is what we call ‘endo.’ In fairness to ECOP, they promise that no member will ever again practice endo. We hope that the members of ECCP will do the same,” Bello said.

Bello cited examples where waiters working for a hotel and sales ladies in malls should be deemed regular employees and not be outsourced by the principal because the nature of their job is directly related to the business of the establishment.

“You cannot operate a hotel without waiters, and without salesgirls, you cannot sell merchandise in malls. Likewise, they should be regular employees. That is the essence of the SOT bill,” Bello explained.

The labor chief differentiated the simplified categories for work employment indicated in the bill, which are regular, probationary, project-based, and seasonal workers.

“The bill has simplified work status in these four categories. For instance, during Christmas or enrolment season, customers go to the mall to buy notebooks and educational supplies, so you need to beef up your sales staff who will attend to a large number of customers. You can hire them from legitimate service providers and they are called ‘seasonal workers’ and by law, this is allowed,” the labor chief added.

Undersecretary Ana Dione, who was with Secretary Bello during the open forum, said under the SOT bill, employers are given the opportunity to determine industries where a certain job should be directly related to the business of the company and it will be discussed in the Tripartite council conferences.

The ECCP is a membership organization which have close to 800 members. It is a bilateral foreign chamber that promotes European interests in the Philippines and vice versa. Employer hinimok na itaguyod ang seguridad sa trabaho 

Hinimok ng labor department ang mga employer sa pribadong sektor na itaguyod ang karapatan ng mga manggagawang Filipino sa seguridad sa trabaho at tulungan ang pamahalaan na wakasan ang iligal na pamamaraan ng kontraktuwalisasyon o ‘endo.’

Sa isang pagpupulong kasama ang mga opisyal at kasapi ng European Chamber of Commerce in the Philippines sa Makati Shangri-la, sinabi ni Labor and Employment Secretary Silvestre Bello III na naniniwala siya na lalagdaan ni Pangulong Rodrigo Duterte ang panukalang Security of Tenure (SOT).

Ang panukalang SOT ay isa sa mga pangunahing lehislatura na sinertipikahan ng Pangulo bilang urgent. Nilalayon nitong amyendahan ang Labor Code na nagbabawal sa labor-only contracting at iba pang probisyon na nagpapaphintulot sa mga kasunduan na pangongontrata.

“Sinasamantala ng ilang employer ang salitang ‘probationary employees’. Kumukuha sila ng mga manggagawa na kunwari ay sasailalim sa anim na buwang probationary status. Gayunman, ang manggagawa ay tatanggalin bago matapos ang nasabing panahon. Ito ang tinatawag na ‘endo’. Nangako naman ang ECOP na lahat ng miyembro nila ay hindi na magpapatupad ng nakasanayang endo. Umaasa kami na gayundin ang gagawin ng mga kasapi ng ECCP,” ani Bello.

Binanggit ni Bello ang mga halimbawa tulad ng pagtatrabaho ng mga waiter sa hotel at saleslady sa mall na dapat ay tinuturing na regular na empleyado at hindi dapat ina-outsource ng principal dahil ang kanilang trabaho ay may direktang relasyon sa negosyo ng establisyamento.

“Hindi ninyo mapapatakbo ang hotel ng walang waiter, at kung walang saleslady, hindi niyo mabebenta ang inyong mga produkto.” Dahil dito, dapat silang maging regular na empleyado. Ito ang pinakadiwa ng panukalang SOT,” paliwanag ni Bello.

Binanggit din ng kalihim ang pagkakaiba ng simpleng kategorya sa trabaho na nakasaad sa panukala, ito ay ang regular, probationary, project-based, at seasonal workers.

“Ginawang simple ng panukala ang estado sa trabaho sa nabanggit na apat na kategorya.  Halimbawa, tuwing Kapaskuhan o pasukan sa paaralan, nagpupunta ang mga mamimili sa mall upang bumili ng notebook at gamit sa pag-aaral, kaya kinakailangan ninyong dagdagan ang inyong mga empleyado na mag-aasikaso sa malaking bilang ng kostumer.  Maaari ninyo silang kunin mula sa lehitimong service provider at sila ang tinatawag na ‘seasonal worker’ at ayon sa batas, ito ay pinapayagan,” dagdag ng kalihim.

Sinabi ni Undersecretary Ana Dione, na kasama ni Secretary Bello sa pulong, sa ilalim ng panukalang SOT, binibigyan ang mga employer ng oportunidad upang alamin ang industriya kung saan ang isang trabaho ay direktang kailangan sa negosyo ng kompanya at ito ay pag-uusapan sa pagpupulong ng tripartite council.

Ang ECCP ay isang membership organization na may 800 miyembro. Ito ay isang bilateral foreign chamber na nagtataguyod sa interes ng Europe sa Pilipinas at bisebersa. Nagbibigay ito ng oportunidad sa negosyo, nangangasiwa sa business contact, at nagbibigay ng market intelligence research para sa mga kompanya ng Europe at Pilipinas.
