DOLE warns vs. fake POEA certification
A modus of withdrawing escrow deposits of recruitment agencies using falsified “certificate of no pending appealed case” was uncovered by the Department of Labor and Employment.
This prompted Secretary Silvestre Bello III to immediately issue a public warning yesterday.
“We are informing the public that a falsified “Certification of No Pending Appealed POEA case” allegedly issued by the Department of Labor and Employment Legal Service has been circulating and is being used by unknown individuals in withdrawing escrow deposits of certain recruitment agencies. We advise the public to be more prudent and cautious in dealing with persons or entities involved in this reported fraudulent activity,” Bello said.
DOLE separately received letters from at least two overseas recruitment agencies inquiring about the authenticity of a certification allegedly issued by DOLE Legal Service and was purportedly used to withdraw an escrow deposit.
A thorough investigation revealed that the said certification was found to be bogus and was never issued by DOLE Legal Service and that the supposed signatory of the document is no longer connected with the labor department.
The Philippine Overseas Employment Administration (POEA) mandates that a recruitment agency shall set-up an escrow account to cover possible future liabilities arising from claims of overseas contract workers due to employment contract violations.
The release of escrow which is deposited in a POEA-accredited bank is ordered by either the POEA or the National Labor Relations Commission (NLRC).
A DOLE-issued certification of “no pending POEA case on appeal” is a requirement to withdraw escrow deposits by recruitment agencies.
Bello is enjoining the public to call 527-3000 local 610 if they had been victimized by the bogus certification or have lead to the culprits of the said fake document. # # # GSR

Natuklasan ng Department of Labor and Employment ang bagong modus ng pagwi-withdraw ng escrow deposit ng recruitment agency gamit ang pekeng “certificate of no pending appealed case.”
Kaya agad naglabas ng babala sa publiko si Labor and Employment Secretary Silvestre H. Bello III.
“Ipinaaalam namin sa publiko na may lumalabas na pekeng “Certification of No Pending Appealed POEA case” na diumano’y inisyu ng Department of Labor and Employment-Legal Service at ginagamit ng mga hindi kilalang indibidwal upang ma-withdraw ang escrow deposit ng ilang recruitment agency. Pinapayuhan namin ang publiko na maging mapagmatyag at maging maingat sa pakikipag-transaksiyon sa mga taong sangkot sa naiulat na pekeng gawain,” ani Bello.
Nakatanggap ang DOLE ng magkahiwalay na sulat sa may dalawang overseas recruitment agency na nagtatanong sa awtentisidad ng certification na umano’y inisyu ng DOLE Legal Service at ginagamit para ma-withdraw ang escrow deposit.
Sa ginawang masusing imbestigasyon, natuklasan na ang nasabing certification ay peke at hindi inisyu ng DOLE Legal Service at ang diumanong nakalagda sa dokumento ay hindi na konektado sa labor department.
Inaatas ng Philippine Overseas Employment Administration (POEA) ang pagkakaroon ng recruitment agency ng escrow account para sa posibleng babayaran sa overseas contract worker bunga ng paglabag sa kontrata sa empleo.
Ang paglalabas ng escrow na naka-deposito sa POEA-accredited bank ay maaaring iatas lamang ng POEA o ng National Labor Relations Commission (NLRC).
Isa sa kinakailangang dokumento ay certificate na inisyu ng DOLE na “no pending POEA case on appeal” para ma-withdraw ang escrow deposit ng recruitment agency.
Hinihikayat ni Bello ang publiko na tumawag sa 527-3000 local 610 kung sila ay naging biktima ng pekeng certificate o may nalalaman sila na makakapagturo sa mga taong sangkot sa pamemeke ng dokumento.
