DOLE resumes labor inspection

Labor Secretary Silvestre Bello III has ordered the resumption of nationwide labor inspections after temporarily suspending it in December to ensure establishments’ compliance with labor laws.

In Administrative Order No. 11, Series of 2022 issued on January 19, Bello authorized the Department’s labor inspectors to conduct routine inspections, complaint inspection, occupational safety and health standards investigation, and special inspection in establishments until December 31, 2022, unless earlier revoked.

Bello also tasked the DOLE Regional Directors to issue the corresponding authority to inspect and investigate specific establishments or workplaces.

Under the Administrative Order, over 600 labor inspectors were given authority to conduct labor inspection activities in establishments nationwide.

Meanwhile, 126 technical safety inspectors were authorized to conduct Technical Safety Inspection of boilers, pressure vessels, internal combustion engines, elevators, hoisting equipment, electrical wirings, and other mechanical equipment installation.

In addition, technical safety inspectors who are registered mechanical and electrical engineers are directed to conduct initial review and evaluation of mechanical and electrical plans for the issuance of Permit to Operate for mechanical equipment and Certificate of Electrical Inspection for electrical wiring installations.

Technical safety inspectors are labor inspectors who are also registered or professional engineers and have undergone Technical Safety Inspection Training.

In the same order, Bello also reminded that only designated Hearing Officers shall conduct mandatory conferences for inspections with noted violations.

Among those authorized are 485 Hearing Officers tasked to conduct mandatory conferences after the lapse of the correction period for violations of general labor standards, occupational safety and health standards, and contracting or subcontracting rules.

Lastly, 115 regional office personnel were designated as Sheriff who will take charge in the enforcement of issued writs of execution, implementation of decisions, and performance of final decisions and orders.

In December, Bello directed all DOLE regional directors to temporarily cease all labor inspection activities in their respective regions to enable the Department to dispose of all pending labor standards cases and prepare the inspection program for 2022.

A total of 90,327 establishments covering 3.7 million workers were inspected in 2021. END/aldm

Labor inspection muling ipagpapatuloy ng DOLE

Matapos itong pansamantalang suspindihin noong Disyembre ng nakaraang taon, ipinag-utos ni Labor Secretary Silvestre Bello III na ipagpatuloy ang mga labor inspection sa buong bansa upang matiyak ang pagsunod ng mga establisyimento sa mga batas-paggawa.

Ayon sa Administrative Order No. 11, Series of 2022 na ipinalabas noong ika-19 ng Enero, pinahintulutan ni Bello ang mga labor inspector ng Kagawaran na magsagawa ng mga karaniwang inspeksyon, pagsisiyasat ng mga pamantayan sa kaligtasan at kalusugan sa paggawa, inspeksyon sa mga reklamo, at espesyal na inspeksyon sa mga establisimyento hanggang sa ika-31 ng Disyembre 2022, maliban kung mas maaga itong babawiin.

Inatasan din ni Bello ang mga Regional Director ng DOLE na maglabas ng kaukulang kautusan sa kani-kanilang nasasakupan na mag-inspeksyon at mag-imbestiga sa mga partikular na establisimyento o lugar-paggawa.

Sa ilalim ng nabanggit na Administrative Order, mahigit 600 labor inspectors ang binigyan ng awtoridad na magsagawa ng labor inspection sa mga establisimyento sa buong bansa.

Samantala, 126 na mga technical safety inspector ang pinahintulutan na magsagawa ng Technical Safety Inspection ng mga boiler, pressure vessel, internal combustion engine, elevator, hoisting equipment, electrical wirings, at iba pang mga mechanical equipment installation.

Dagdag dito, ang mga technical safety inspector na mga lisensyadong mechanical at electrical engineer ay inaatasan na magsagawa ng paunang pagsusuri at pagtatasa sa mechanical at electrical plans para sa pagbibigay ng Permit to Operate ng mechanical equipment at Certificate of Electrical Inspection para sa mga electrical wiring installation.

Ang mga technical safety inspector ay mga labor inspector ng DOLE na pawang lisensyado o mga professional engineer na sumailalim sa Technical Safety Inspection Training.

Sa nasabing kautusan, pinaalalahanan din ni Bello na ang mga itinalagang Hearing Officers lamang ang magsasagawa ng mandatory conferences para sa mga inspeksyon na kinakitaan ng mga paglabag.

Kabilang sa mga awtorisado ang 485 Hearing Officers na inatasang magsagawa ng mga mandatory conference matapos ang panahon ng pagwawasto o “correction period” para sa mga paglabag sa pangkalahatang pamantayan sa paggawa, mga pamantayan sa kaligtasan at kalusugan sa trabaho, at mga panuntunan sa pangongontrata o sub-contracting.

Panghuli, 115 regional office personnel ang itinalaga bilang Sheriff na mangangasiwa sa pagpapatupad ng mga ipinalabas na writ of execution, pagpapatupad ng mga desisyon, at pagganap ng mga pinal na desisyon at kautusan.

Matatandaan na nitong nakaraang Disyembre, inatasan ni Bello ang lahat ng mga DOLE regional director ang pansamantalang ipagpapatigil ng lahat ng aktibidad na may kinalaman sa labor inspection sa kani-kanilang mga rehiyon upang bigyang-daan ang Kagawaran na tapusin ang lahat ng mga nakabinbing kaso sa labor standards at maihanda ang inspection program para sa taong 2022.

Umabot sa 90,327 ang bilang ng mga establisyimento na sumasaklaw sa 3.7 milyong manggagawa sa buong bansa ang dumaan sa inspeksyon noong 2021. END/aldm/gmea
