Labor and Employment Secretary Rosalinda Dimapilis-Baldoz has issued Administrative Order No. 540 creating a DOLE Validation Team which will conduct a tripartite validation of the payroll system of Coca-Cola to ensure its compliance with general labor standards.


“The management and union and federations of Coca Cola-FEMSA has requested for the conduct of a tripartite validation of their payroll system.  The validation process started on 15 October and shall be completed by 30 November,” said Baldoz.


She added that the tripartite validation is aimed at ensuring the participation of the representatives of both union and management.


It also seeks to find out if the payroll system of Coca-Cola complies with the provisions of their CBA or Article 100 of the Labor Code. The validating team shall recommend actions to address non-compliance, if there is any, after the tripartite validation.


According to A. O. No. 540, the team shall be composed of the Bureau of Working Conditions (BWC) as Chair; National Conciliation Mediation Board (NCMB) as Vice Chair; and Bureau of Labor Relations (BLR), National Wages and Productivity Commission (NWPC), Regional Tripartite Wages and Productivity Boards (RTWPBs), and all DOLE Regional Offices.


The said administrative order also provides that the BWC shall render technical assistance in the conduct of the tripartite validation of the Coca-Cola FEMSA payroll system.  It shall also consolidate all the reports submitted by the Regional Offices.  A terminal report shall also be submitted to the Secretary after the termination of the validation.


The NCMB shall monitor pending Coca-Cola FEMSA cases, if there is any, and shall provide the BWC with consolidated status report.


The BLR, on the other hand, shall assist the NCMB to facilitate the identification of the representatives of the Coca-Cola management and the unions that shall participate in the validation process.  It shall also assess registered CBA provisions of the payroll system.


The DOLE Regional Offices, in coordination with the BWC and RTWPBs, shall spearhead the conduct of the validation at the Coca-Cola head office and plant sites as recommended by the DOLE validation team.  The concerned RO shall submit a report to the BWC.


Baldoz added that the tripartite validation activity shall start at the Coca-Cola head office because of the centralized payroll system. This activity will be led by DOLE-NCR.  The plant sites in Region 3 and 4-A shall be validated by the DOLE Validation Team.
