ABS CBN counsel slammed for intellectual dishonesty

Labor Secretary Silvestre Bello III today accused the lawyers of ABS CBN of intellectual dishonesty for claiming that the labor department has tacit approval of the seasonal work arrangement for the broadcast firm’s program employees.

“They are intellectually dishonest,” Bello said, stressing that the policy referred to and adopted more than 40 years ago was declared by the courts in 2004 to be invalid.

“To cite a policy that has been stricken down by the courts to have no basis in law and in fact is plain and simple dishonesty meant to mislead the people and the members of Congress,” he added.

In a hearing at the House on Tuesday, ABS CBN counsels pointed to Policy Instruction No. 40 as basis for classifying workers in the broadcast company. The lawyers however did not state that such policy was issued in 1979, leaving the impression that the policy was that of Bello’s.

The labor department earlier took strong exceptions to claims that it has found ABS CBN compliant with labor laws and standards.

It said labor inspectors found violations of laws and standards by ABS CBN. And on account of those findings, the company took steps to correct those infractions.

“It is therefore patently misleading to attribute to us the claim that ABS CBN is a compliant company. In fact, there are 67 pending cases against the company in the NLRC and the various courts,” DOLE said in a statement.

Bello said, “Correcting the violations committed by ABS CBN after inspection did not make it a compliant company.” ###


Mga abogado ng ABS CBN, inakusahan ng intellectual dishonesty

Inakusahan ni Labor Secretary Silvestre Bello III ang mga abogado ng ABS CBN ng intellectual dishonesty dahil sa pahayag na aprubado ng kagawaran ang seasonal work arrangement ng mga manggagawa sa mga programa ng naturang kumpanya.

“Sila ay intellectually dishonest,” wika ni Bello, habang binibigyang-diin ang batayang ginamit ng kumpanya na isang polisiya na higit 40 taon na at naideklara ng mga korte noong 2004 na ‘invalid.’

“Para banggitin ang isang polisiya na hindi sinang-ayunan ng mga korte dahil wala itong batayan sa batas ay isang uri ng pagsisinungaling upang linlangin ang publiko at mga miyembro ng kongreso,” dagdag pa niya.

Sa ginanap na pagdinig sa kongreso nitong Martes, binanggit ng mga abogado ng ABS CBN ang Policy Instruction No. 40 bilang batayan para sa pag-classify ng mga manggagawa ng nasabing kumpanya. Subalit hindi binanggit ng mga abogado na ang nasabing polisiya ay inisyu pa noong 1979 at parang pinalalabas na ito ay inisyu ni Bello.

Itinanggi rin ng DOLE ang mga pahayag na napatunayan umanong compliant ang ABS CBN sa mga labor law at standard.

Sinabi pa niya na ayon sa mga labor inspector, mayroong mga paglabag sa batas at standards ang ABS CBN at nang makita ang mga paglabag na ito, gumawa na rin ng hakbangin ang kumpanya upang maitama ang mga ito.

“Masasabi nating hindi tama na sabihing mula sa DOLE ang mga pahayag na isang compliant na kumpanya ang ABS CBN. Sa katunayan, mayroon pa silang 67 na pending na kaso sa NLRC at sa iba pang korte,” ayon pa sa statement ng DOLE.

Ani Bello, “Hindi nangangahulungang isang compliant na kumpanya ang ABS CBN kung itinama lamang nito ang kanilang mga paglabag matapos ang isang inspeksyon.” ###
