·         Formulate a legislative agenda aimed at making reforms in labor laws that enable environment and trade policy to be linked to employment generation.

·         It aims to help poor and unemployed workers improve their welfare and economic conditions by providing short-term work and income opportunities
 
·         ROs to look at the labor component of infrastructure projects; PESOs are expected to be active in the project
 
·         Ensure compliance with the provisions of RA 6685 in the implementation of infrastructure projects/community employment schemes (private contractor and sub contractor to source out atleast 50% of the unskilled and 30% of the skilled requirements locally)

·         Conduct a consultation (Jobs Summit) before the end of the year that would result to a Jobs Pact among government, employers, workers and other multi-sectoral partners.

c.       Jobs Pact
·         The Jobs Pact aims at placing employment at the center of economic growth , a decent work in all aspects of labor policies and programs

·         Institutionalization of all PESOs
 
·         Identify and provide technical assistance to PESOs who can institutionalize them by way of financial and human resources support from the local chief executives.
 
·         Target is for the institutionalization of all the 1,700 PESOs nationwide.
 
·         As of date, there are 49 institutionalized PESOs

Setting of multi-media communication system to strengthen labor market information
·         Strengthen the provision of public employment services, particularly through timely labor market information (LMI) on the hard-to-fill and in-demand occupations to all schools, colleges and universities, local government units down to the level of the barangay.

Area of Concern :   Labor Arbitration and Adjudication Systems
·         National Efficiency and Integrity Board
·         Institutionalize National Efficiency and Integrity Board (EIB) and set up agency EIBs in all DOLE offices nationwide.
 
·         Shall serve as a monitoring body for all corruption cases involving DOLE officials and personnel, including workers and employers. It can also direct investigations and recommend actions to address clogged case dockets, and delay in the dispensation of labor justice.

·         30-day mandatory conciliation-mediation for labor cases
·         Institutionalize the single-entry approach for all DOLE cases by implementing 30-day mandatory conciliation-mediation in all regional offices up to the provincial level. 
 
·         Citizen’s Charter
·         Citizens’ Charter implemented in compliance with the Anti-Red Tape Act (ARTA)
 
·         Covers 15 DOLE frontline services at the central, regional and labor offices abroad.

·         Present results of ILO inspection audit to the national TIPC for tripartite discussion. ·         Prioritize strategic bills to enhance the competitiveness of enterprises and industries.
 
·         Consultation with partners to adjust existing labor law and align labor market globalization.
 
Area of Concern :   Align Labor Policies with International Treaties and ILO Conventions
·         Sustain action on the recommendations of the ILO High Level Mission on Freedom of Association and Collective Bargaining
·         Allocate continuing appropriation for the operation of the High-Level Tripartite Monitoring Body on the Application of International Labour Standards, in particular ILO Convention on Freedom of Association (C.87).
 
·         Fast track the complete resolution of all cases involving alleged extra judicial killings, harassment and abduction of trade unionists.

·         Consultations for the Maritime Labor Convention
·         Conduct tripartite consultations towards ratification of the Maritime Labor Convention to ensure protection for the country’s international and domestic seafarers.

Workers Welfare and Protection

Area of Concern :   Enhancing Social Protection
·         Unemployment insurance scheme
·         The purpose of unemployment insurance is to cushion or mitigate the impact of job displacements (resulting from economic slowdown), on the working poor and the vulnerable workers.

·         Comprehensive Reintegration Program
·         The program shall consist of personal, family, community services and that will start even before the OFW leaves the country (social security , workmen’s compensation , health insurance ,housing)

·         Intensify Anti-Illegal Recruitment (AIR) campaign at the community level
·         Conduct of pre-employment orientation seminars focusing on anti-illegal recruitment
 
·         Educate recruitment agencies on the Anti-Trafficking Law so that they can be advocates against it. In the advocacy campaign, the use of tri-media will be a priority.

·         Stronger protection on-site
·         This aims to provide stronger protection to migrant workers by expanding on-site services; full psychosocial assistance thru a network of reputable social workers, as well as faith-based and non-government organizations.
 
·         Fully Implement RA 10022, amending Migrant Workers Act of 1995
·         Defines the government’s migration management program with specific measures to better protect migrant workers.
POEA, OWWA, NRCO, and the POLOs
·         Faster repatriation of trafficked migrant workers. 
·         Work with the embassy and other relevant offices/ agencies to fast track resolution of cases of trafficked migrant workers in FWRCs. Repatriation will be immediately facilitated for those found qualified as soon as their travel or exit documents are completed.

Area of Concern :   Constitutional rights and the right to participate in the policy-making processes
·         LEAP (Labor Enforcement and Action Program)
 
·         Intensify labor inspection on towards increased compliance with labor standards covering establishments employing 10-199 workers (i.e. terms and conditions of employment, safety and health, social security, and even contracting where only independent contracting is allowed and labor-only contracting is prohibited)
 
·         Coverage includes the incidence of child labor and social protection under SSS and PhilHealth.
 
·         Target is 60,000 establishments nationwide and increase compliance rate from 50% to 70%
BWC, ROs
·         Minimum Wage Fixing
·         Two-tier wage policy reform:
a.       National mandatory floor, or “living” wage
b.      Industry productivity and performance-based flexible wage
 
·         Setting of mandatory floor wage to protect the incomes of the most vulnerable workers in the labor market and an industry productivity and performance-based flexible wage scheme.

Area of Concern :   Zero- and Performance- based Budgeting
·         Realignment of assistance to workers in the informal economy to micro enterprises and small businesses in the formal sector
·         Focus budget item on helping micro enterprises which account for 92 per cent of all establishments or numbering 697,077. They will be assisted through technical assistance visits (TAV) to help establishments and workers in productivity improvement so that they are able to gradually comply with labor standards.

Area of Concern :   Streamlines and Rationalized Structure; QS and Eligibility
·         Implementation of Rationalization Plan
·         DOLE R-Plan was approved by the Department of Budget and Management (DBM) on April 13, 2009 and has been implemented by the Department. As a result, most of the services and programs have become more accessible to clients with full decentralization of functions and resources to provincial field offices.
 
·         At present there are 83 provincial field offices and 4 satellite offices nationwide.
 
·         Among the twelve (12) attached agencies, only the rationalization plans of the National Conciliation and Mediation Board (NCMB) and the Institute for Labor Studies (ILS) had already been approved by the DBM.

·         Compliance with eligibility requirements
·         All officials occupying Career Executive Service (CES) positions are required to complete the eligibility process and obtain the CES eligibility

Area of Concern :   Performance Management System- Office Performance Evaluation System (PMS-OPES)
·         Rational and systematic evaluation of performance
·         At present the DOLE makes use of the Modified Performance Evaluation System (MPES) in evaluating the performance of the rank-and-file and complies with the Career Executive Service Performance Evaluation System (CESPES) for the directors and above.
